Proposed Motor Carrier Rules
This page provides information about pending and recent rulemaking actions by ODOT's Motor Carrier Division. The date of the OTC meeting at which consideration is anticipated is listed below.

 General Penalties
ODOT assesses general penalties for violations of statutes and rules related to motor carrier safety and progressive levels of penalties based on the motor carrier’s compliance history.  A carrier that repeats similar violations is subject to a suspension of operating authority, in addition to any monetary penalties. The proposed amendment adds provisions related drug and alcohol testing or use to the classifications for which "similar violations" are determined.

These proposals are no longer open for public comment. The Oregon Transportation Commission will consider approval of these proposed rule changes on the date listed below.

 Annual Readoption of FMCSR and HazMat Regulations
These amendments cover the annual adoption of federal motor carrier safety and hazardous materials transportation regulations and the adoption of international standards related to driver, vehicle and hazardous materials out-of-service violations.

 Annual Readoption of IFTA and HVUT
These amendments readopt Title 26 CFR Part 41 (HVUT) and International Fuel Tax Agreement (IFTA), effective January 1, 2012, to ensure Oregon remains current with national commercial motor vehicle registration standards and international IFTA standards.

Recently Adopted Motor Carrier Rules
These rules have been adopted by ODOT approximately within the last six months.
 Authority to Impose Travel Restrictions (Permanent)
This rule delegates authority to the Motor Carrier Transportation Division Administrator to impose restrictions on travel involving over-dimension loads or vehicles to protect the public or state infrastructure.

 Miscellaneous Motor Carrier Rules
Division 75 changes relate to transportation of mobile homes and modular building units; Division 76 changes relate to the issuance of permits allowing tow vehicles to tow oversize disabled vehicles on state highways

 Legibility of Highway Use Tax Reports
The amendment establishes the standard criteria for which highway use tax reports submitted to the Department will be accepted as legible and readable.

 Maximum Fine Schedule
This amendment implements HB 2712 which establishes one presumptive fine for each class of violations and eliminates the confusing way fines have historically been calculated.

 Inadequate Motor Carrier Records
These rules describe requirements for maintenance and production of motor carrier records, and associated penalties for failure to produce records.

 Oversize Load Signs
Some self-propelled cranes do not have enough space on the front or rear of the vehicle to accommodate a sign the size required by rule without blocking headlights, turn signals, license plate, brake lights or taillights. The amended rule allows a vehicle’s bumpers to be painted yellow and bear the words “OVERSIZE  LOAD” painted or decaled in black.
